3.2 Account creation

Access to the service requires creating an account via:

  • an email address and password;
  • a Google account (OAuth 2.0);
  • an Apple account (Sign in with Apple).

You undertake to provide accurate, complete information and to keep it up to date. An account may only be used by a single natural person; account sharing is prohibited.

3.3 Account security

You are responsible for the confidentiality of your login credentials. You are bound by any use of your account, whether or not you authorized it. If you suspect your account has been compromised, you must notify the Publisher as soon as possible at bleepy.app@gmail.com.

5. Use rules and user obligations

5.1 Lawful use

You undertake to use Bleepy exclusively for lawful purposes consistent with its intended use. You must not:

  • send messages that harass, discriminate, threaten, are obscene, misleading, or harm human dignity;
  • use the service to distribute unsolicited content (spam) or circumvent send limits (rate limiting);
  • create fake accounts or impersonate a third party;
  • automate use of the app (bots, scripts) without the Publisher’s prior written consent;
  • attempt to access unauthorized features or data, reverse engineer, or compromise service security.

5.2 Quick message content

Quick messages (system or custom) must comply with:

  • No illegal, discriminatory, hateful, threatening content, or content infringing third‑party rights.
  • Technical limits: 40 UTF‑8 characters maximum per message variant (default value; configurable per deployment) and 5 words maximum (7 words if at least one word is a single letter).

The Publisher may remove any message that fails to comply without prior notice.

5.3 Group and member administration

An Owner is responsible for:

  • administering their Group and permissions granted to members;
  • how the Group is used by members where the Owner granted corresponding sending or inviting rights;
  • ensuring invited members comply with these Terms.

The invitation mechanism (link, QR code) may only be used by members with the explicit “invite” right granted by the Owner.

5.4 Device permissions

Bleepy requires the following permissions on your device:

  • Push notifications: essential for the core feature. Without this permission, you will not receive notifications from your groups.
  • Camera: used only to scan invitation QR codes. You may join a group via link if camera access is denied.

6. Intellectual property

6.1 Publisher rights

The Bleepy app, source code, design, trademarks, logos, service architecture, catalog system messages, and all Publisher‑produced content are the exclusive property of the Publisher or licensed to the Publisher. Any reproduction, modification, distribution, or commercial exploitation without permission is strictly prohibited.

6.2 User‑generated content

Custom messages you create in Bleepy remain your property. By publishing them on the platform, you grant the Publisher a limited, non‑exclusive, worldwide, royalty‑free licence to host, display, and transmit those messages as needed for normal operation of the service.

7. Personal data and privacy

7.1 Data controller

Processing of personal data collected through Bleepy is carried out by [Name and contact details of the data controller — to complete], in accordance with the General Data Protection Regulation (GDPR — EU 2016/679) and applicable French law.

7.2 Data collected

The following data may be collected in operating the service:

  • Identification data: email address, display name, OAuth provider identifier (Google / Apple).
  • Group data: group membership, roles, invitation history (including inviting user).
  • Send metadata: who sent what message to which Group and when (notification content is not stored in the database — push‑only architecture).
  • Technical data: push notification tokens, IP address, access and security logs (minimum retention: 30 days).
  • Preferences: preferred language, allowed languages per group, notification sounds.

7.3 Purposes of processing

Data is processed to:

  • provide the service (authentication, sending notifications, group management);
  • ensure security and traceability (audit, debugging, abuse prevention);
  • improve the service (aggregate analytics — detailed individual metrics are reserved for the institutional Premium offering);
  • meet legal obligations.

7.4 User rights

Under the GDPR you have rights of access, rectification, erasure, restriction, portability, and objection regarding your personal data. These rights may be exercised at [privacy@bleepy.app — to confirm]. Where a complaint is not resolved, you may contact CNIL — the French data protection supervisory authority (Commission nationale de l'informatique et des Libertés).

7.5 Retention and deletion

  • Account data are kept for the lifetime of the account, then erased within [to be defined, e.g. 30 days] after account closure.
  • Security logs are kept for at least 30 days.
  • Deleting an account erases associated personal data, subject to statutory retention obligations.

The full privacy policy is available at [URL — to complete] and supplements these Terms.

8. Service availability and quality

The Publisher will use reasonable efforts to ensure service availability (target: ≥ 99.5% monthly for MVP), delivery of notifications (target: ≥ 98% over 24 h), and API performance (target: < 200 ms p95).

These targets are indicative and do not constitute a contractual service level guarantee (SLA), except where expressly agreed in writing under a Premium offering.

The Publisher may perform maintenance operations, with or without notice, potentially causing temporary unavailability.

9. Limitation of liability

To the extent permitted by applicable law:

  • The Publisher shall not be liable for indirect damages resulting from using or inability to use the service (loss of opportunity, loss of profits, commercial harm).
  • The Publisher is not responsible for custom messages created by Users or for consequences of how notifications are used within a Group.
  • The Publisher is not responsible for failures of third‑party notification services (Apple APNs, Google FCM) or telecommunications networks.
  • The Publisher’s total liability under these Terms is limited to the amount actually paid by the User in the 12 months before the triggering event (paid offerings only).

10. Suspension and termination

10.1 Termination by the User

You may close your account at any time from your profile settings in the app. Closure leads to deletion of your data as described in Section 7.5.

10.2 Suspension or termination by the Publisher

The Publisher may suspend or delete any account:

  • where these Terms are breached;
  • in case of fraudulent or abusive conduct;
  • for any safety or integrity reason affecting the service.

Users will be notified where practicable unless immediate action is required (security, fraud).

11. Store compliance (Apple App Store / Google Play)

Bleepy is distributed via the Apple App Store and Google Play Store. By using the service, you also accept the applicable distribution platform’s terms. Each released version follows a compliance checklist aligning in‑app legal screens, store metadata, and the published policy (FR-016, NFR-009).

12. Changes to the Terms

The Publisher may change these Terms at any time. Material changes will be notified through the application or by email at least 15 days before they take effect. Continued use of Bleepy after that date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the app and close your account.

13. Applicable law and competent jurisdiction

These Terms are governed by French law. In the event of a dispute relating to their interpretation or performance, absent an amicable settlement, the parties submit to the exclusive jurisdiction of the courts of [city of the Publisher’s registered office — to complete], except where mandatory law requires another competent forum (particularly for consumers).
